Terms of Service (TOS) Agreement
Introduction and Acceptance
This Terms of Service Agreement (“Agreement”) governs the use of services provided by Josta Access Ride & Caring Companion (“Josta,” “We,” “Us,” or “Our”), a private home health aide and non-emergency medical transport provider based in Collier County, Florida. By booking or utilizing any of our services, the Client (“You” or “Your”) agrees to be bound by these terms.
1. Scope of Services
Josta Access Ride & Caring Companion offers two primary divisions of service:
Companion Care Services: Provision of customized, RN-supervised, non-skilled home health aide services (including personal care, companionship, meal prep, and errands) in accordance with Florida Administrative Code 59A-8.
Transportation Services: Provision of non-emergency door-to-door medical and general transportation (NEMT, general shuttles, and specialized mobility transport).
Exclusions: We do not provide emergency medical services. In the event of a medical emergency, we will immediately contact 911 (Emergency Services). We do not provide skilled nursing care or administer medication.
2. Service Booking and Cancellation
Service Agreement: All services begin with a comprehensive RN assessment and the establishment of a Custom Care Plan or agreed-upon trip booking details.
Cancellations (Companion Care): Notice of cancellation for scheduled shifts must be provided at least 24 hours in advance. Failure to provide sufficient notice may result in a minimum cancellation fee equivalent to 2 hours of service.
Cancellations (Transportation): Notice of cancellation for scheduled rides must be provided at least 2 hours in advance. Short-notice cancellations or failure to be present at the pickup location may result in a cancellation fee.
3. Financial Terms and Payment
Rates: Service rates are based on the type, duration, and complexity of the care or transport required (e.g., standard transport vs. VIP service vs. specialized stretcher transport). Rates are communicated to the Client prior to the service commencement.
Payment: Payment for services rendered is due upon receipt of the invoice. We accept major credit cards and other forms of payment as agreed upon.
VIP Services: VIP Concierge Services may require a retainer or a fixed membership fee, which will be detailed in a separate VIP Service Agreement.
4. Client and Staff Safety
Client Rights: Clients retain all rights, including the right to dignity, privacy, self-determination, and the right to file a grievance, as outlined in our Client Rights & Responsibilities Policy.
Safe Environment: The Client agrees to provide a safe, non-abusive, and non-threatening working environment for our staff (HHAs, drivers, and managers). Josta reserves the right to immediately withdraw services if staff safety is compromised.
HIPAA Compliance: We maintain strict adherence to HIPAA standards regarding the privacy and security of Client health information. Secure, HIPAA-compliant electronic health records are used for all files.
5. Limitation of Liability
Josta Access Ride & Caring Companion and its parent organization, CEI Business Solutions Inc, shall not be liable for any indirect, incidental, special, or consequential damages resulting from the use or inability to use the services, except in cases of proven gross negligence or willful misconduct by Josta’s staff. Our liability is limited to the fees paid by the Client for the specific services during which the incident occurred.
6. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Florida, and any legal action arising from this agreement shall be initiated in the appropriate court in Collier County, Florida.
